WHAT DO I DO WITH MY POOL CARD IF I MOVE?

If you move out of the Windstone neighborhood, place your pool card in the HOA drop box at the west pool.  A new card will need to be issued to the new homeowner.

AS A NEW NEIGHBOR, HOW CAN I GET A POOL CARD ISSUED TO ME?

WHEN WILL THE POOLS BE OPEN? CLOSE?

Both pools normally open on May 15th & close on September 15th, of each year, however depending on weather conditions the pools have been in past years been open until September 30th. (This will be decided by the Board of Directors)

WHEN ARE ASSESSMENTS DUE AND HOW SHOULD I PAY?

Assessments are due July 1st of each year.  If assessment is not paid by July 31th, a 10% penalty will be charged on total amount due.

Home+Alley assessment is $875.00

Home without alley access is $625.00

Delinquent accounts as of September 1, of each year will be turned over to collections and all fees for collection will become the responsibility of the homeowner.

ANSWERS TO FACEBOOK CONCERNS

The role of the board is to protect and increase property value.  This is accomplished by operating the association, maintaining the common property, and enforcing the governing documents.

Why won't the HOA Board respond to comments on Facebook?

We understand that Facebook can be a useful tool for providing timely information to our homeowners, for example, notification of alley closing during paving.  We do use Facebook for that purpose.

How must does it cost Windstone for each non-compliance letter sent by Keith Collins?

$.62 each, actual cost to the HOA with 467 homes @$.001 each.

When/why are non-compliance letters sent and referred to attorneys?

The HOA sends a series of 3 letters before it ever gets referred to an attorney, unless unusual circumstances are warranted, for example, violation of any laws of the City of Olive Branch.  Non-Compliance notifications are issued by attorneys only after the homeowner has been previously notified by Keith Collins at the request of the HOA and/or to address issues that do not comply with the laws of the City of Olive Branch.  The first letter is a courtesy letter, which is a nice reminder that your property needs maintenance.  If needed, a second notice, and if a lack of compliance continues to be an issue a final letter is sent with a notice of possible legal action, if directed by the Board.

The letter is a way to remind owners of what they have promised to do by acceptance of a warranty deed to property that has covenant compliance rules and regulations.

Please note that the HOA and management company resort to legal action only when the homeowner refuses to respond and comply.

Article XII, Miscellaneous, Section 6, page 24 of 40

"The Association shall have the right to enforce the covenants and restrictions contained in this Declaration or applicable to Windstone by any proceeding at law or in equity, violations to require specific performance and/or to recover damages; and against the land to enforce any lien created by these covenants; and failure by the Association or any Member to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter.  The expense of enforcement, including court costs, expenses, and attorney's fees, by the Association or Member shall be chargeable to the Owner of the Lot violating these covenants and restrictions and shall constitute a lien on the Lot, collectible in the same manner as assessments here under."

Our Community Association Manager, Tammy Joyner, has been with Keith S. Collins Company 10 years in July.  Prior to that she spent 10 years managing not-for-profit commercial real estate membership associations.  She currently manages a portfolio of about 40 properties, including Southwind, Plantation Lakes, Dickens Place, and Cherry Tree Park...all large scale associations like Windstone.  Tammy has two sets of professional credentials, a Certified Manager of Community Associations certification and the Association Management Specialist designation, both earned and maintained with continuing education through Community Associations Institute (CAI).  She is also the Chair of the West TN CAI Regional Council and a member of the Legislative Action Committee, working at state and national level on legislation affecting HOAs.  Keith S. Collins Company is BBB Accredited with an A+ rating.

WHY DOES THE HOA NEED MY EMAIL ADDRESS?

The HOA is presently working on an email list to contact homeowners in case of emergency, maintenance issues (road or alley closure), correspondence, and events in Windstone.  When the above information is sent out by email, it saves in postage and copy costs for the HOA, wich in turn saves on future expense of HOA dues.  Please send your email address to windstonehoaboard@gmail.com.

SELLING YOUR HOME: CAN THE HOMEOWNER SELL TO A PERSON(S) OR COMPANY WHO PLANS TO BUY THE HOME FOR RENTAL PURPOSES?

The October 31, 2017 Amended and Restated Declaration of Covenants and Restrictions prohibits the purchase of any home for rental purposes; therefore, any home sold after the above date cannot be rental property.

ACC QUESTION: HOW DO I APPLY TO GET APPROVAL FOR CHANGES TO THE OUTSIDE OF MY HOME?

Application Process-Changes to the outside appearance of your home or lot require prior approval from the ACC.  You must receive written approval from the ACC prior to beginning any project.

Applications can be found at www.mywindstone.com or from Caliber at www.keithcollinsco.com.

The ARA application will need to be printed from one of the above locations and completed with all information requested.  There are two (2) ways to forward the application:

(1) The ARA application and any supporting documents can be sent by mail to Keith Collins Management Company, 3036 Centre Street, Germantown, TN 38138, ATTN: Tammy Joyner or email to tjoyner@keithcollinsco.com.

(2) The ARA application and any supporting documents can be placed in the HOA Drop Box located at the west pool.

ALL exterior changes require PRIOR approval per Covenants.  Per our CCR's Article IX, Section 2, page 21 of 40, "In the event the ACC fails to approve or disapprove any plans and specifications as herein provided within thirty (30) days after submission .... the same shall be deemed to have been approved as submitted... If any structure, fence, or barrier shall be altered, erected, placed or maintained (including exterior maintenance) .... otherwise in accordance with plans and specifications approved by the ACC... shall be deemed to have been undertaken in violation of the restrictions... and without approval required... shall be removed or re-altered and such use shall be terminated so as to extinguish such violations."You may contact the HOA Board at: windstonehoaboard@gmail.com or mail to Keith S Collins Management, LLC, 3036 Centre Street, Germantown, TN 38138
